Name infringement?

Quick question, if I WOMFed something about a company where I really received bad service and warn others not to use such company, can they turn around and sue me or something for name infringement? I did put my real name down right at the end....oops. Is there a way to delete it again? Probably too late, hey?

Legal Action

It all depends on what you said and how you said it. If you spoke about something that actually happened to you then they do not really have much recourse, especially if you can prove that what you say happened did in fact happen. A general warning to people to avoid a certain business should never need to end up in you getting sued, after all the company has just as much power to come back at you on a site like womf and say that you are talking rubbish and defend themselves.

That brings us to 'how' you said whatever it was you said. If you simply stuck to the facts and a general warning I would say that you are safe, if however you verbally insulted the business or owners and attacked their reputations or business directly in a 'personal' fashion they could have recourse. Of course on womf you have the added safety-net of being anonymous - companies can sue to have your details released but they will only do so in very dire situations and if you really attacked them in a way that was unjust and uncalled for.

If you want a post of yours removed from the site get hold of me and I will speak to the moderators for you.

Thanks

Thanks Deacon

Not sure whether I actually want to delete it, as I really do want to warn others about this company. Makes sense what you're saying. And no, in no way did I attack them personally, I simply stated what happened, what service I got and what I thought of it.

Have look at professional services: alarms&security.

Thanks again!

IANAL

Libel requires the "offended" party to prove financial loss relating to the "offending" incident.
